User Agreement

Floswimming is an entity of Flocasts LLC. Floswimming is an electronic running log and coaching tool that can incorporate social networking within a team (members and coaches) and people outside one's team. Logs are entries about your workout. If you are registered within a team your coaches will be able to see all of your logs, which include any notes about your workout. If you do not wish for your coaches to see this information you should leave the team in Floswimming and change to an individual account. Contact support@flocasts.org for help. When you use Floswimming, you may set up your personal profile, form relationships, send messages, perform searches and queries, form teams, set up practices and events, and transmit information through various channels like posts, Floswimming messages, email and texts. We collect this information so that we can provide you the service and offer personalized features. In most cases, we retain it so that, for instance, you can return to view prior messages you have sent or easily see your friend list. Information Collection and Use by Floswimming: Floswimming collects user submitted information such as name, email address, and age to authenticate users and to send notifications to those users relating to the Floswimming service. Floswimming also collects other profile data including but not limited to: personal interests, gender, age, education, school, location in order to assist users in finding and communicating with each other. Invitations and Other Communications to Non-members Floswimming members can invite friends to join the service by sending invitation emails via our invitation system. Floswimming stores the email addresses that members provide so that the respondents may be added to the friend's list of the member sending the invitations, and also to send reminders of the invitations Flotrckr does not sell these email addresses or use them to send any other communication besides invitations, invitation reminders (up to three (3) per email address) and to track the success of our referral program. Recipients of invitations from Floswimming may contact Floswimming to request the removal of their information from our database. Floswimming also logs non-personally-identifiable information including IP address, profile information, aggregate user data, and browser type, from users and visitors to the site. This data is used to manage the website, track usage and improve the website services. User IP addresses are recorded for security and monitoring purposes You post User Content on the Site at your own risk. Although we allow you to limit access to your pages, please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other Users with whom you may choose to share your pages and information. Therefore, we cannot and do not guarantee that User Content you post on the Site will not be viewed by unauthorized persons. We are not responsible for circumvention of any privacy settings or security measures contained on the Site. You understand and acknowledge that, even after removal, copies of User Content may remain viewable if other Users have copied or stored your User Content. Password: When you sign up to become a registered user, you will also be asked to choose a password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the user account or password of another Member at any time or to disclose your password to any third party. You agree to notify Flocasts immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account. Any improper collection or misuse of information provided on Flotackr is a violation of the Floswimming Terms of Service and should be reported to privacy@Flocasts.org Floswimming does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please do not attempt to register for Floswimming or send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 may provide any personal information to or on Floswimming. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 13, please contact us at privacy@flocasts.org Children Between the Ages of 13 and 18: We recommend that minors over the age of 13 ask their parents for permission before sending any information about themselves to anyone over the Internet. Non-commercial Use by Registered Users. The Floswimming Services are for the personal use of registered users only and may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by Floswimming. Illegal and/or unauthorized use of the Floswimming Services, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email or unauthorized framing of or linking to the Floswimming Website is prohibited. Commercial advertisements, affiliate links, and other forms of solicitation may be removed from Profiles without notice and may result in termination of user registration. Appropriate legal action will be taken for any illegal or unauthorized use of the Floswimming Services. Profile information is used by Floswimming primarily to be presented back to and edited by you when you access the service and to be presented to others permitted to view that information by your privacy settings. In some cases where your privacy settings permit it (e.g., posting to your wall), other Floswimming users may be able to supplement your profile. Profile information you submit to Floswimming will be available to users of Floswimming who is your friend teammate or coach. Your name, team and network names, and profile picture thumbnail will be available in search results across the Floswimming network and those limited pieces of information may be made available to third party search engines. This is primarily so your friends can find you and send a friend request. People who see your name in searches, however, will not be able to access your profile information unless they have a relationship to you (friend, teammate, coach or member of your networks, etc.) Floswimming may send you service-related announcements from time to time through the general operation of the service. For instance, if a coach sends you a new message, or someone posts on your team's wall, you may receive an email or text message alerting you to that fact. When you use Floswimming, certain information you post or share with third parties (e.g., a friend or someone on your team), such as personal information, comments, messages, and photos. Floswimming may contain links to other websites. We are of course not responsible for the privacy practices of other web sites. We encourage our users to be aware when they leave our site to read the privacy statements of each and every web site that collects personally identifiable information. This Privacy Policy applies solely to information collected by Floswimming. This Agreement is accepted upon your use of the Floswimming Website or any of the Floswimming or Floswimming Services and is further affirmed by you becoming a user. This Agreement constitutes the entire agreement between you and Floswimming regarding the use of the Floswimming Services. The failure of Floswimming to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. The section titles in this Agreement are for convenience only and have no legal or contractual effect. This Agreement operates to the fullest extent permissible by law. If any provision of this Agreement is unlawful, void or unenforceable, that provision is deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions.
